What Mr.Johnny saya is correct but not always. At times the guideline value fixed by the government is much in excess. At such circumstances the aggrieved party has some other avenues for redressal of which the following are the two:

1. The party can register the document paying a lower stamp duty.The document will be retained in the Registrar office and will be referred to the Deputy Collector [Stamps]
for inspection of the site and finalisation of the correct stamp duty to be paid. This is the practice followed in Tamilnadu.
2. He can approach the court for levying the correct stamp duty.

Many or almost every one is cheating the government on stamp duty and registration by hiding the actual market value of the property. This had led wide corruption in the office of the registrar. Hence the government has fixed an amount as value of the property in each area.So accoring the present rules and regulation every body has to pay the stamp duty based on the govt. tarrif not on the actual amount of sale.

The govt. tariff is always less than the market value.Nobody can help- your friend in this matter.

Dear All,

We are struggling with a serious problem.

Problem is:-

One of my intimate friend brought a land in Kerala with the rate of 14 lakh (Original amount to pay the owner)
Now, during registration, as per the new rule of Kerala Government states that, he need to pay the tax amount of 24 lakhs instead of 14 lakhs, because as per the Government record the tariff value of that
land is 24 lakhs.

Now, he need to pay around 1 lakh ruppees extra tax to the Government for Land registration.
Is there any body experienced the same problem in this group?

Any idea, what to do?
