Dear Pradeep,
 
The court order was apt in this particular case.
The extension of leave can be withdrawn in case shortage of staff in the department.
But the court findings are baseless and not on aware of the facts.
Only job security is the advantage from the state in case they approve for the leave.
 
ALLEGATIONS
  • All benefits are availed during the leave period
  • Makes workload for the remaining staff due to their absence
  • Avail Pension on retirement even after the long leave
  • Curtails the chance for the new recruitments
FACTS
  • The employee is totally out of the service till he joins back.
  • No salary, promotion, PF, gratuity, Pension on the leave period.
  • All the vacancies are being filled by PSC in case somebody proceed on long leave so that there wont be any workload.
  • Also the person has to wait till the next vacancy comes in case he joins back after the long leave.
  • The employee should work a minimum of 9 years and 3 months to avail a minimum and nominal pension. Leave period is not counted on any reasons
  • Also a govt. employee on leave is not eligible for any benefits from NORKA as a pravasee. (pravasee pension, insurances)
  • PF is the amount they get on retirement with interest which is the amount deducted from their salary on their working period.
  • Also gratuity is counted only for the working years in the service.
  • No increments or promotions on the leave period
  • Retains only the position on which he started his long leave and has to work under the juniors later.
  • Govt. is not loosing anything while permitting them to leave in loss of pay, in turn they get more flow of foreing currency.
Many are working in the overseas and state itself after availing Loss of Pay leave from the government. It is only with their talents and efforts. Many are taken leave for the higher education purpose too.
Govt. can cancel/amend the orders so that nobody shall get long leave further, in place of the court verdict of dismissing the employees. On leave persons should join back on the completion of their present leave period.
 
But this will further cut short the job vacancies in the state and a threat to the new job seekers.
