In no country in the world, in no state in the country or in the central civil service or for that purpose not in any reputed organisation in the world such a ridiculous provision exists that their employees can take leave and work any where they want and come back when they feel so, excepting in Kerala Government. If any one has the qualification and experience to get a job with higher perks and salary than the State Service, he should resign the Government job and leave the vacancy to the less fortunate ones who are still unemployed.
The Hight court judgement referred to one is a land mark judgement aimed at bringing in social justice in the state realising the unemployment problem in the state and the Judge need to be congratulated for his courage to tell the Kerala Government to stop this practice.
Dear Mr. Joshi, you have the right to call names and attribute motives to the Judge since, I am sure, you are one among the persons, who is affected by this judgement; but be careful you can be prosecuted for contempt of court for what you have stated in your posting. I am responding to your comments about the judge, to tell the world that you do not represent the wisdom of the state, but only your selfishness.
One last point, if you feel agitated over the judgement, you should file an appeal in the Supreme Court rather than casting aspersions on the High Court Judges, who are much more learned than you

ഇതോടനുബന്ധിച്ചുള്ള ഹിന്ദു വര്‍ത്ത കാണുക. അതിലെ പരാമര്‍ശങ്ങള്‍ കാര്യങ്ങള് മനഃസ്സിലാക്കാത്ത ഒരു സാധാരണക്കാരന്‍റേതു പോലുമാകില്ല.
കേരള സര്‍വ്വീസ് റൂള്‍സ് പ്രകാരമാണ് കേരളത്തിലെ സര്ക്കാര് ജീവനക്കാരുടെ സേവന വ്യവസ്ഥകള്‍ ക്രമീകരിച്ചിരിക്കുന്നത്. സുപ്രീം കോടതി അടക്കം നിരവധി കോടതികള്‍ ഇതിലെ ചട്ടങ്ങള്‍ പരിശോധിച്ച് അംഗീകരിച്ചിട്ടുള്ളതാണ്. അതിലെ റൂള്‍ 88 പ്രകാരം (അനുബന്ധം 12എ പ്രകാരവും) ഒരു സര്ക്കാര് ജീവനക്കാരന് തുടര്‍ച്ചയായോ അല്ലാതെയോ 20 വര്‍ഷം വരെ ശംബളമില്ലാത്ത അവധി സര്‍ക്കാരിന് അനുവദിക്കാം. ഇങ്ങനെ പോയ എല്ലാവര്ക്കും സര്ക്കാര് ഉത്തരവ് നല്‍കിയട്ടുണ്ട്. ആ തസ്തികയില്‍ മറ്റൊരാളെ ഉടന്‍ പി.എസ്സ്.സി മുഖേനയോ മറ്റോ നിയമിക്കും. ലീവില്‍ പോകുന്ന ആളിന് യാതൊരു ആനുകൂല്യത്തിനും അതായത് ഇംക്രിമെന്‍റ്, അവധി ശംബളം, പ്രമോഷന്‍, പെന്‍ഷന്‍, ഗ്രാറ്റുവിറ്റി തുടങ്ങിയ യാതൊരു കാര്യത്തിനും ഈ ലീവ് കാലയളവ് പരിഗണിക്കുന്നില്ല. സര്‍ക്കാരിന് വേണമെങ്കില്‍ ഓരാളുടെ സേവനം ഇവിടെ ആവശ്യമുണ്ടെങ്കില്‍ ഇത്തരം ലീവ് നല്‍കാതിരിക്കാം അല്ലെങ്കില്‍ ലീവ് നല്‍കിയ ഒരാളെ എപ്പോള്‍ വേണമെങ്കിലും തിരിച്ചു വിളിക്കാം. ഇതൊക്കെ കോടതികള്‍ അംഗീകരിച്ചിട്ടുള്ളതാണ്. തൊഴിലില്ലായ്മ പെരുകിയ നമ്മുടെ നാട്ടില്‍, സര്ക്കാര് ജീവനക്കാര്‍ കുറേപ്പേര്‍ തങ്ങളുടെ സ്വയം അന്വഷണത്തില്‍ വിദേശത്ത് ഒരു ജോലി തേടി പോയാല്‍ ഉടന്‍ ആ തസ്തികയില്‍ മറ്റൊരാളെ നിയമിക്കാം. കഴിവുള്ളവരെ കിട്ടാന്‍ പ്രയാസമുള്ള ഡോക്ടര്മാര് തുടങ്ങിയവര്ക്ക് ലീവ് നല്‍കുന്നത് പരിമിതപ്പെടുത്തിയിട്ടുണ്ട്. വാര്ത്തയില് പറയുന്ന സംഭവത്തില് പരാതിക്കാരിയായ നേഴ്സിന് സര്ക്കാര് ലീവ് നീട്ടി നല്കിയല്ല. അവര് കോടതിയെ സമീപിച്ചു. കോടതി അംഗീകരിച്ചില്ല. ഇതുവരെ എല്ലാവര്ക്കും അംഗീകരിക്കാം. കൂട്ടത്തില് പബ്ലിസിറ്റിക്കാകാം പറഞ്ഞ മറ്റു കാര്യങ്ങള് ന്യായ്ധിപന്മാരുടെ അന്തസ്സിനു ചേര്ന്നതല്ല.
