Re: [www.keralites.net] LEGAL AWARENESS ON looking after our parents.

Hello there,

Had noted the response. and am really happy that , at least "all is not lost " for such helpless parents. But the scenario in our society is that, when the poor parents start suffering at the hands of their own children, with nobody "interested" to take their "responsibility" or nobody to give them "monthly maintenance" , parents  will not have any means or ways to approach the "court of law"... either due to sheer ignorance or due to the shortage of financial support needed for such procedures. and in our existing legal  modalities, by the verdict comes out on such cases, it would be too late !

In such situations, for such parents who don't have even the financial support to start legal procedures, what do you suggest ? anything is existing in our society for such parents ?

regards to all members.

Dear friends,
I am Adv. TKG.Nambiar, now at Dubai till the end of this month. i had been responding to some such mails earlier. Now this seems to be a problem.  Many of our friends do not know the legal rights of each individual.  Parents / old people have many RIGHTS  now. If any one of us ignore or disregard our parents they can approach a court and get order for their maintenence, the quantum of money to be paid to the parents would depend on your income. Even banks are to give loans to them if they pledge the property they have for their maintenance/living.  it is a new law and many of our friends are not aware of it.  similarly there are many new laws which specifically protect your rights.  you should atleast try to understand some laws, especially that concerns you.
I suggest that you get acquainted with PROTECTION OF WOMEN FROM DOMESTIC VIOLENCE ACT, CONSUMER PROTECTION ACT, I.T.ACT AND CYBER LAWS, RIGHT TO INFORMATION ACT etc. also.  if you are aware of your rights you will be able to get your right share.
The KERALA STATE LEGAL SERVICE AUTHORITY with its vast net work in the Courts are helping to make people legally literate.  being one of the faculty members at Kozhikode Dt., I along with my friends conduct LEGAL LITERACY CLASSES FOR COLLEGE STUDENTS, KUDUMBA SREE UNITS, PANCHAYATHS, HIGH SCHOOLS, AND AT PLACES ON REQUEST BY ANGANWADI WORKERS ETC., LEGAL CLINICS AT VARIOUS PANCHAYATHS FOR IMPARTING FREE LEGAL AID, AND ALSO WE APPEAR IN COURTS ON BEHALF OF THOSE ACCUSED IN CRIMINAL CASES, WHERE HE/SHE IS NOT ABLE TO ENGAGE A LAWYER BASED ON THEIR REQUEST, FOR ANY FEMALE WHO IS ACCUSED OF ANY CRIME, GIRLS AND BOYS ETC. So try to get maximum information from all sources.
DO ASK FOR INFORMATION (BE IT FROM ANY GOVERNMENT OFFICE - CENTRAL OR STATE -, DEPARTMENTAL ORGANISATION, BANKS, PANCHAYATH, POLICE, COURTS ETC.) UNDER RIGHT TO INFORMATION ACT.  YOUR EXPENSE IS ONLY RS.10 AND A REQUEST IN WRITING ABOUT THE INFORMATION YOU WANT.  BE AWARE OF LAWS AND RULES THAT IS TO YOUR ADVANTAGE.  WILL POST MORE INFORMATION LATER. THANKS FOR READING. BYE.
